Tripping & Slipping Accidents in Shops & Unsafe Premises

Occupiers of premises, for instance the owner of a shop, can be liable for any injury caused to a visitor if the premises are dangerous, hazardous or steps have not been taken to ensure that the premises are ‘reasonably safe’.

This also includes land – such as external areas of premises, gardens, open sites, wasteland and even empty fields.

Trespassers or a person who is injured whilst on premises without legal permission to be there can in some cases also make a claim. For example, a child who is injured whilst playing on the site of a derelict or unsafe building. In such cases a claim could be brought if the owners of the building knew or ought to have known that children might play at the site and they failed to take steps to prevent children from entering.

Different legal rules apply to compensation claims depending upon whether the injured person was a trespasser or lawful visitor to premises at the time of the accident.
