Accidents at Work: Compensation for Construction Site Accidents

Compensation claims for construction workers injured at work. Building sites can be dangerous places and industrial injuries and accidents at work are common in the construction industry.

Common construction site accidents which give rise to compensation claims:

  • accidents whilst working at height
  • falls from ladders
  • accidents involving scaffolds
  • tripping accidents
  • work equipment accidents
  • manual handling and lifting injuries
  • accidents involving plant and vehicles

Employee or self-employed? Who can claim for a construction site accident?

A construction industry employee who suffers an industrial injury or accident at work as a result of a breach of duty on the part of his or her employer can bring a claim for compensation against the employer (or more usually the employer’s insurers).

However, many workers on building sites work as self-employed contractors. The fact that a worker is self-employed at the time of a building site accident does not automatically prevent a claim for compensation. The courts have, in certain circumstances, held that self-employed sub-contractors are entitled to rely upon the safety duties imposed upon an employer for providing a safe place or safe system of work. The main considerations are to identify in whose business the injured worker was working and who had control of the work and the situation which caused the accident.

The issues relating to building site accidents and construction site industrial injury compensation claims can be complex. It is therefore important that expert advice is obtained. Beckett & Co Solicitors have the necessary expertise to determine who is to blame and if a claim can be made.
