Preston worker awarded £6800 after a machinery accident at work claim
Beckett & Co Solicitors have recently won personal injury compensation on behalf of a client who suffered an injury in a machinery accident at work in Preston.
Personal injury solicitor, Donna Beckett, brought an accident at work claim against the employer’s insurance company on the basis that the employer had failed to ensure that the machine was fitted with an easily accessed emergency stop control and had failed to provide the claimant with adequate training regarding the safe use of the machine.
The company initially disputed the claim but after further investigation of various branches of health and safety at work regulations liability was subsequently admitted.
Evidence was obtained to support the claim including medical evidence which confirmed that the client had sustained a severe fracture to his finger and as a result of his injury he had been unable to work for 15 weeks. A claim was made for personal injury compensation and loss of earnings.
After submission of evidence the employer’s insurance company made an offer to settle the claim for £5000.00 which, following our advice, was rejected. Following further negotiations with the insurers Beckett & Co secured a final compensation award of £6800.00. The client received 100% of the compensation.
Beckett & Co handled the claim on a No win – No fee basis which meant that the legal costs of the claim were paid by the insurance company in addition to the compensation. This ensured that the injured claimant did not have to pay any costs in connection with the claim and allowed him to keep 100% of his compensation without any deductions.
